The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with Kaya Brands Ltd, company number 11763618.

  1. General

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with Kaya Brands Ltd., hereinafter referred to as “Kaya Turello”, “us” or ”we”, at the Kaya Turello website, mobile website, or mobile application, or via telephone (jointly referred to as ”kayaturello.com”).

By using kayaturello.com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order.

Only persons 18 years or older, who are not under guardianship, and are not acting in a capacity of a company can place an order.

The inclusion of any products or services on kayaturello.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on kayaturello.com at the time you place your order.

Kaya Turello want to provide the best possible online experience. To make this possible we need to ensure that our services runs like a clockwork. You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the kayaturello.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these terms and conditions.

  1. Prices and delivery charges

The prices displayed at kayaturello.com do not include the statutory Value Added Tax and a delivery charge. We currently do not include VAT in our prices, therefore international orders are not subject to VAT refunds.

The delivery charge for each order depends on the place of delivery indicated by the customer.

  1. Ordering/conclusion of contract

The ordering option available to you is via kayaturello.com

Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfill your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, a Kaya Turello representative will contact you to settle the refund.

  1. Delivery

We charge a small fee for delivery of our items, which allows us to keep our prices affordable as the delivery premium is not included in the price of all our garments. You decide how many pieces you like, reducing the cost of delivery per item with the size of your order.

Kaya Turello exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order worldwide.

UK Delivery

We charge a flat fee of GBP 5 regardless of the size if your order. Our courier of choice MyHermes. Tracking will be available as soon as the order is dispatched (typically within 1-2 business days), delivery takes 1-4 business days (excl. Sundays) depending on the location within the UK. You will receive an e-mail confirmation with your tracking number, so you know where exactly your parcel is and when is due to arrive. MyHermes app also allows you to add delivery instructions for the courier.

From time to time the courier company may vary if we find one that can deliver your order quicker, however we will always confirm the courier company and tracking number when your delivery is despatched.

Channel Islands (Guernsey and Jersey)

We charge a flat fee of GBP 10 regardless of the size of your order. Sent with Royal Mail 1st Class Signed for service. Tracking number will be provided once your parcel is despatched.

Scottish Highlands and Islands

We charge a flat fee of GBP 5 regardless of the size if your order. Our courier of choice is MyHermes. Typically your order will be delivered within 2-6 business days. From time to time we may vary the courier that we use if an alternative provider can deliver your order quicker.

Ireland

Flat fee of GBP 8 with MyHermes, deliveries typically take 5-10 days. From time to time we may vary the courier that we use if an alternative provider can deliver your order quicker.

International

We ship worldwide and will choose the most competitive courier for your order. Most European orders will be shipped with MyHermes and the rest of the world orders with DPD. Expected delivery times will vary depending on the destination but most will be delivered within 2-7 business days. We may vary our default couriers if others are able to deliver quicker.

Most European countries – MyHermes, GBP 10

Poland – DPD, GBP 12

USA – DPD, GBP 25

Australia – DPD, GBP 25             

South Africa – DPD, GBP 40

Outside of the EU, any applicable import customs duty and taxes will be billed to the customer. We currently do not include VAT in our prices, therefore international orders are not subject to VAT refunds.

  1. Withdrawal of Order

You may cancel or return your order within 14 days of receiving the order.

  1. Returns

UK RETURNS

We know that you will love out suits are therefore are happy to cover the cost of potential UK mainland return, should you not be 100% satisfied with your power look.

Returns are easy:

  • Log in to your account and open the Orders Tab. Choose the order you want to return and click “Ask for a refund” or “Refund entire order”.
  • If you don’t have an account use the return form link in the footer or click here.
  • Fill in the return form or request a refund within 14 days of receiving the order and we will send you a free MyHermes label so you can drop off your parcel at the nearest MyHermes Parcel Shop or have it collected.
  • Drop off your parcel within 5 days of receiving the return label.
  • Ensure the items are returned unworn, unwashed and with the original tags to qualify for refund
  • Include your return reference in the package
  • Once your return has arrived, please allow 5-7 business days for your refund to be processed.
  • Keep your postage confirmation until the refund has been issued. If the items have not reached us, we will not be in the position to issue a refund.
  • We reserve the right not to accept a return if the goods have been worn, damaged or washed or do not include original tags.
  • Refunds are made to the credit card used for the original purchase and PayPal.

INTERNATIONAL RETURNS

Returns are easy:

  • Log in to your account and open the Orders Tab. Choose the order you want to return and click “Ask for a refund” or “Refund entire order”.
  • If you don’t have an account use the return form link in the footer or click here.
  • Fill in the return form or request a refund within 14 days of receiving the order.
  • Book a courier to our address including your return reference on the address label.
  • The cost on international returns is at the expense of the customer.
  • We recommend using a tracked courier service. Delivery of returned goods is the responsibility of the customer, if the goods do not reach us, we will not be in the position to issue a refund.
  • Clearly mark the return packages ‘British Return Goods’ as your returned items are not applicable to customs duties and taxes once they reach the UK.
  • You can update the tracking reference on your return form.
  • com is a useful courier comparison platform which we use for managing your orders.
  • Ensure the items are returned unworn, unwashed and with the original tags to qualify for refund
  • We reserve the right not to accept a return if the goods have been worn, damaged or washed or do not include original tags or if the delivery has not reached us.
  1. Payment methods

You can pay for your goods in 2 ways as set out below. We accept payment before delivery only.

Stripe: Credit card or debit card

You can enter your payment details at the time you place your order using a valid credit or debit card (VISA or Mastercard). Kaya Turello reserves the right to check the validity of the credit or debit card, its credit status in relation to the order value and whether the address data of the purchaser is correct. We may refuse orders depending on the result of these checks.

PayPal

When paying by PayPal, Kaya Turello reserves the right to check the validity of the PayPal account, that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. Kaya Turello reserves the right to deny any purchase.

  1. Our Liability

Nothing in these Terms shall exclude or limit Kaya Turello’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

Kaya Turello accepts liability for death or personal injury caused by our negligence or that of our employees. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.

Kaya Turello is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.

Our maximum liability to you for any loss or damage arising in connection with your order on kayaturello.com shall be limited to the total price of your order.

If you have a problem with a product that you have purchased from Kaya Turello online, and were not able to settle the complaint with Kaya Turello, then you can submit your complaint to the EU’s online dispute resolution platform (the “ODR platform”).

The ODR platform offers consumers and traders within the EU with the possibility to try and reach an out-of-court settlement for complaints arising from online purchases. This single entry point is designed to be a user-friendly and interactive website, available in all EU official languages and free of charge. Using the ODR platform the consumer and the trader can find a dispute resolution body and then go through the process of finding a solution to the consumer’s complaint.   1. Colours and measurements

We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

An item’s measurements given on kayaturello.com are only approximate values to give you a better understanding of the model or fit of that specific item, and not a definite guarantee of the actual measurements of the item you receive. The final measurements of an item may vary depending on the material used in its production.

  1. Guarantee

If there are defects in the goods you have purchased, Kaya Turello abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the return form or by requesting a refund on your account page.

  1. Assignment

Kaya Turello reserves the right to assign or pledge to third parties any claim(s) for payment including any payment instalments which have arisen in connection with the delivery of goods.

  1. Severance

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

  1. Ownership of rights

All intellectual property rights, such as trademarks and copyrights at kayaturello.com remain with Kaya Brands Ltd and its subsidiaries or licensors. Any use of kayaturello.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Kaya Turello.
